1. Acceptance of Terms

By using SantaPetPhotos, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

2. Description of Service

SantaPetPhotos provides an AI-powered service that generates festive photos of pets with Santa Claus. Users upload photos of their pets, and our AI technology creates holiday-themed images.

3. User Eligibility

You must be at least 18 years old to use this service. By using SantaPetPhotos, you represent and warrant that you are at least 18 years of age.

4. User Content and Consent

You agree that:

  • You own or have the right to use all photos you upload to our service
  • You will only upload photos of pets that you own or have permission to photograph
  • You will not upload photos containing people, especially minors
  • You will not upload offensive, illegal, or inappropriate content

5. Prohibited Uses

You agree not to use the service to:

  • Upload content that violates any law or regulation
  • Create content depicting minors or people without their consent
  • Generate deepfakes or deceptive content
  • Harass, abuse, or harm others
  • Distribute malware or engage in any malicious activity
  • Violate the intellectual property rights of others

6. Content Ownership and License

You retain ownership of all photos you upload to SantaPetPhotos. The AI-generated photos created by our service are yours to use as you wish.

By uploading content to our service, you grant SantaPetPhotos a limited, non-exclusive license to use your uploaded photos solely for the purpose of generating your Santa pet photos and improving our AI models.

7. Payment and Refunds

SantaPetPhotos offers a free trial with your first photo. Additional photos require payment as outlined on our pricing page.

Due to the immediate nature of our AI processing and associated computational costs, all sales are final. We do not offer refunds except where required by law.

8. Service Availability

We strive to provide uninterrupted service but cannot guarantee that our service will always be available. We may modify, suspend, or discontinue the service at any time without notice.

9. Limitation of Liability

To the maximum extent permitted by law, SantaPetPhotos and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability for all claims shall not exceed the amount you paid to us in the 12 months preceding the claim, or AUD $100, whichever is greater.

10. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Indemnification

You agree to indemnify and hold harmless SantaPetPhotos and its operators from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these terms.

12. Data Retention and Deletion

We will retain your uploaded photos and generated images for a limited time as outlined in our Privacy Policy. You may request deletion of your data at any time by contacting us.

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the service constitutes acceptance of the modified terms.

14. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

15. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and SantaPetPhotos regarding the use of our service.
